STATES WHERE CBD IS “ILLEGAL”
Currently, every state in the United States of America allows some form of CBD usage. In most states, CBD is fully legal, while in other states, it is legal with some restrictions.
Still, we always recommend checking with the local laws where you live. This article is not legal advice and you should always consult with a legal expert if you are in doubt.

USAGE RESTRICTIONS BY STATE:
IDAHO – The Idaho Statute Section 37-2705 defines schedule I controlled substances following Federal Law as a compound, mixture, preparation, or material that contains any traces of either THC or marijuana.
Therefore, for CBD to not be a controlled substance in Idaho, two conditions must be satisfied:
- The CBD oil/product CANNOT contain any quantity of tetrahydrocannabinol and not just less than 0.3%.
- The CBD oil extract cannot be considered as ‘marijuana’ under Idaho Statute Section 37-2705.
IOWA – only allowed if the product comes from a USDA-approved state. Ohio is USDA approved.
KANSAS – residents of Kansas can buy CBD oil or products derived thereof with 0% THC
MISSISSIPPI – CBD oil or products derived thereof is allowed only if it comes from hemp. However, CBD oil products must have 0.3% THC or no THC at all.
NORTH CAROLINA – All hemp-derived CBD products with less than .3% THC are permitted as long as they are not prohibited by the Food and Drug Administration (FDA) or U.S. Department of Agriculture (USDA).
SOUTH CAROLINA – The answer is yes, CBD oil is legal in South Carolina in 2020. Along with CBD oil, most other CBD-infused products, such as CBD tinctures, capsules, creams, and so forth, are also legal (see list of CBD products below).
The one exception, as we mentioned above is smokable hemp flower. Although this is still being debated, stores across the state have been pulling smokable hemp off their shelves for fear of being raided.
Although smokable hemp can still be purchased online, it’s inadvisable to smoke hemp in public as it smells just like weed and is likely to get you arrested.
Furthermore, any products produced from marijuana or any products produced from hemp that have more than 0.3 percent CBD are illegal in the state. If you’re caught with such products, you can be subject to the penalties of the state’s marijuana laws.
TENNESSEE – The bottom line is that CBD oil, assuming it is produced from hemp and contains under 0.3 percent THC, is legal for all Tennesseans.
VIRGINIA – Yes. Currently, CBD oil from the hemp plant is legally prohibited throughout the state of Virginia. These products are legal if they don’t contain more than 0.3% THC.
